A federal appeals court paused the transfer of SpaceX’s lawsuit challenging the constitutionality of the National Labor Relations Board, giving Elon Musk’s spacecraft firm a chance to contest a lower court’s order sending the case from Texas to California.
The US Court of Appeals for the Fifth Circuit halted the transfer in a one-sentence order Tuesday saying the move is stayed “pending further order of this court.”
SpaceX is trying to stop the case from shifting from a more favorable litigation venue for its constitutional claims against the NLRB in terms of circuit court precedent and appellate review.
