SpaceX Asks Judge to Nix Transfer of Labor Board Challenge (1)

SpaceX asked a federal judge in Texas to cancel his order sending one of the company’s constitutional lawsuits against the National Labor Relations Board to California.

Judge Rolando Olvera, an Obama appointee in the US District Court for the Southern District of Texas, lacked jurisdiction to order the transfer because a federal appellate court has control of the dispute, the Elon Musk-owned aerospace company argued July 26.

The motion is the latest salvo in the litigation over the proper venue for SpaceX’s case, which raises several constitutional challenges to the NLRB’s structure. The company filed the lawsuit in January as ...
