Software Engineer’s H-1B Visa Wrongly Denied, Judge Rules

Software provider InspectionXpert Corp. will get another chance at hiring a “quality engineer” on a temporary high-skilled visa, following a federal judge’s ruling that the company’s H-1B petition was unreasonably denied.

U.S. Citizenship and Immigration Services erred in its decision that the engineering position wasn’t a “specialty occupation,” and failed to consider all of the evidence the North Carolina company submitted to prove why Sathish Kasilingam’s position qualified for an H-1B visa, Judge L. Patrick Auld of the U.S. District Court for the Middle District of North Carolina ruled Thursday.
