More than 100 delivery drivers in New Jersey may proceed as a certified class on claims that Sleepy’s LLC violated state wage laws by misclassifying them as independent contractors, a federal judge ruled after the Third Circuit weighed in on the matter.
The U.S. Court of Appeals for the Third Circuit already held that the proposed class was ascertainable, and the drivers have shown that their claims can be resolved through common evidence that predominates over any individual differences, Judge Peter G. Sheridan said Wednesday in granting their renewed motion.
