Six-Month Delay in Visa Action Not Yet Unreasonable, Judge Says

A group of Indian nationals can’t sue over the delayed adjudication of their petitions for immigrant investor visas before they’ve waited longer than the average processing time, a Texas federal judge ruled.

The plaintiffs, Aashish Chuttani, Suman Siddamreddy, and Bharat Uppalapati, asked the court to find that a six month wait to receive an approval or denial of their EB-5 visas from U.S. Citizenship and Immigration Services constituted an unreasonable delay under federal law.
