Shoe Retailer Fails to End Manual Worker’s NY Pay-Delay Lawsuit

A shoe store operator must face allegations of failing to timely pay manual workers after a federal judge declined to nix a private right of action in the wake of a new split of authority among New York state courts.

The worker can sue BG Retail LLC, which operates Famous Footwear and Naturalizer shoe stores, to enforce a state law requiring weekly pay for manual laborers, the US District Court for the Southern District of New York said.
