Shipt ‘Shopper’ Must Arbitrate Wage Suit Over Contractor Status

Shipt Inc., Target Corp.'s on-demand delivery service, convinced a federal judge in Illinois to enforce an arbitration pact against a former personal shopper who claims she and others were misclassified as independent contractors instead of employees.

Shoppers, as a nationwide class, aren’t involved in interstate commerce because they don’t regularly cross state lines in the course of their work, Judge Edmond E. Chang of the U.S. District Court for the Northern District of Illinois said Monday.

As such, they can’t use the Federal Arbitration Act’s exemption for transportation workers to avoid arbitrating claims against Shipt, the court said.
