Shepherd University’s win in a discrimination case brought by a Chinese chemistry professor who was denied a promotion multiple times was vacated in part by the Fourth Circuit on Monday.
Mengyang Li isn’t required to exhaust remedies before the West Virginia Public Employees Grievance Board to pursue claims for violations of the West Virginia Human Rights Act, the US Court of Appeals for the Fourth Circuit said in an unpublished, unanimous opinion. The lower court made a mistake in dismissing Li’s Title VII race discrimination claims, and must reconsider them on remand, the court said.
