Shelter Maker Gichner Escapes Bias Suit Over Cancer Leave Firing

Gichner Shelter Systems defeated a former designer’s disability bias claims when a federal judge in Pennsylvania ruled his request to extend his cancer treatment leave without a potential return date was unreasonable as a matter of law.

Paul Wojtowicz admitted that at the time of his firing, he didn’t know when he would be well enough to return, so he clearly requested an open-ended and indefinite leave, which the Americans with Disabilities Act doesn’t allow, Judge Jennifer P.
