Shelter Maker Gichner Escapes Bias Suit Over Cancer Leave Firing

Gichner Shelter Systems defeated a former designer’s disability bias claims when a federal judge in Pennsylvania ruled his request to extend his cancer treatment leave without a potential return date was unreasonable as a matter of law.

Paul Wojtowicz admitted that at the time of his firing, he didn’t know when he would be well enough to return, so he clearly requested an open-ended and indefinite leave, which the Americans with Disabilities Act doesn’t allow, Judge Jennifer P. Wilson of the US District Court for the Middle District of Pennsylvania said, granting Gichner summary judgment.
