Shell Chemical LP won’t face trial on job bias claims by an employee who was fired because she missed work after being arrested for driving while intoxicated while on written warning about her attendance issues, the Fifth Circuit ruled Monday.

Former process technician Leah Amedee’s DWI occurred the morning after she received the written warning, which was the second step in Shell’s formal employee discipline process, the court said.
