Seventh Circuit Nixes Workers’ RICO Claims Over Alcohol Testing

A federal appellate court affirmed the dismissal of an anti-racketeering lawsuit from a group of pilots, a physician, a nurse, and an attorney against a drug testing lab, over claims that allegedly faulty alcohol tests caused significant professional harm.

The US Court of Appeals for the Seventh Circuit held Friday that the 14 professionals made flawed allegations that US Drug Testing Laboratories Inc. violated the Racketeer Influenced and Corrupt Organizations Act by falsely marketing its dried blood spot technology as a reliable method for detecting alcohol use, and reaping financial gains as a result.
