Seventh Circuit Gives Worker Shot to Overcome Late Charge Filing

A federal appeals court revived a worker’s disability discrimination lawsuit against an Illinois power company so a district judge can determine whether she should be allowed to proceed despite missing a deadline for filing a bias charge.

Former Ameren Illinois Co. employee Kimberly Ballard might qualify for leniency based on misrepresentations from a state agency, although a judge must also consider whether she filed as early as possible, the US Court of Appeals for the Seventh Circuit held Tuesday.
