Security Firm’s Union Busting Triggers NLRB Bargaining Order

A divided National Labor Relations Board hit a Texas security firm with a bargaining order to remedy its unlawful union busting, deploying one of the agency’s most potent weapons in its limited enforcement arsenal.

Whitehawk Worldwide’s “pervasive and serious” violations of federal labor law, including threatening to fire workers if they supported a union, merited the bargaining order, the NLRB said in its 2-1 ruling Thursday. The company terminated two workers for their union support, the board said.

“Here, the Respondent’s reaction to its employees’ organizing drive was immediate, swift, and retributive,” the NLRB said.
