A divided National Labor Relations Board rejected a Manhattan public park operator’s challenge to a decision allowing seasonal stage technicians to vote for union representation.
The two Democrats on a three-member NLRB panel Thursday denied Little Island’s request to review a regional director’s ruling that authorized the proposed bargaining unit, finding that the seasonal workers had a reasonable expectation of future employment with the park operator.
The board’s order casts a spotlight on legal issues involved in determining whether seasonal and other intermittent workers can form a union.
