Seasonal H-2B Visa Workers’ Overtime Class Suit Heads to Trial

Landscape seasonal workers hired through the H-2B visa program to work for a Missouri landscaping company may proceed with their certified class and collective action seeking overtime pay their employer allegedly withheld.

Judge Toby Crouse of the US District Court for the District of Kansas on Tuesday granted Rogelio Garcia Valdez and Marbella Gomez’s request to represent more than 800 field workers in their case, saying they’ve “shown that a class-action approach would be preferable to other approaches for fairly and efficiently resolving the issues here, thus satisfying their burden.”
