School Staff Can’t Claim Job Bias Using Title IX, 11th Cir. Says

A former basketball coach and a former art professor from two Georgia universities can’t sue for workplace discrimination under Title IX of federal education law because it doesn’t contain a private right of action for job bias, a federal appeals court ruled.

The Thursday decision from the US Court of Appeals for the Eleventh Circuit went a step further than the core question raised in two consolidated appeals—whether the process for bringing job bias claims under Title VII of the 1964 Civil Rights Act preempts school staff from bringing those claims instead via the gender bias protections of Title IX. ...
