School Employees Lose Free Speech Suit Over Anti-Racism Training

Two employees who sued a Missouri school district over a training that covered themes of anti-racism and equity have lost their free speech suit.

Brooke Henderson and Jennifer Lumley failed to show they suffered injuries because of the training and its subsequent multiple-choice questions. Therefore their claims of compelled speech, chilled speech, and viewpoint discrimination all fell short, the US District Court for the Western District of Missouri ruled Thursday.

The court allowed the district to seek attorneys’ fees, saying students and taxpayers “deserve better” after it described the employees’ arguments as “misguided,” “wholly unreasonable,” and “frivilous.”
