Schneider National Trucker Gets Misclassification Suit Revived

A truck driver can pursue his wage-and-hour claims against Schneider National Inc. after the Seventh Circuit reversed a lower court ruling that failed to look beyond the terms of the worker’s contract.

Under the Fair Labor Standards Act, what matters for determining whether a worker is an employee is the “economic reality of the working relationship, not necessarily the terms of a written contract,” the US Court of Appeals for the Seventh Circuit said Wednesday. Trucker Eric Brant’s allegations on that point “state a viable claim,” the court added.
