A truck driver can pursue his wage-and-hour claims against Schneider National Inc. after the Seventh Circuit reversed a lower court ruling that failed to look beyond the terms of the worker’s contract.
Under the Fair Labor Standards Act, what matters for determining whether a worker is an employee is the “economic reality of the working relationship, not necessarily the terms of a written contract,” the US Court of Appeals for the Seventh Circuit said Wednesday.
