SC Data Wins Suit Over Post-Background Report Pulled Job Offer

SC Data Center Inc. prevailed in a suit alleging it violated federal law by withdrawing a job offer after a background report revealed the applicant hadn’t disclosed felony convictions, as the Eighth Circuit found she wasn’t harmed by the technical violation.

Ria Schumacher didn’t show she suffered a concrete injury as a result of SC Data’s failure to show her a copy of the report before withdrawing its offer, a violation of the Fair Credit Reporting Act, the U.S. Court of Appeals for the Eighth Circuit said.
