San Jose State Settles Professor’s ‘Anti-Indigenous’ Speech Suit

San Jose State University settled a free speech retaliation lawsuit brought by a tenured anthropology professor who said she lost facility access after voicing opinions labeled “anti-indigenous” and “racist” by professors and students.

As part of the parties’ agreement, Elizabeth Weiss voluntarily submitted her resignation effective May 2024, university spokesperson Michelle Smith McDonald told Bloomberg Law. Weiss has decided to retire from academia, her counsel, Wilson Freeman of the Pacific Legal Foundation, said, adding that “resolving the lawsuit was in the best interests of all involved, and an amicable settlement was reached.”
