A Fresno County, Calif., school system pay structure that factors in employees’ salary history may not violate a federal law intended to reduce the gender pay gap, a federal appeals court ruled (Rizo v. Yovino, 2017 BL 139221, 9th Cir., No. 16-15372, 4/27/17).
Fresno County conceded it paid Aileen Rizo, a math consultant in its school system, less than her male peers. It based her pay on a scale that factored in her prior experience as a math teacher and her master’s degree. The county offered four business reasons to justify its salary history-based approach.
