A jury couldn’t find New Jersey’s Rutgers University refused to promote a professor to its highest ranks because of his vision-related disability rather than his lack of qualifications, the Third Circuit ruled Monday.
Prof. Briance Mascarenhas failed to establish he was improperly denied a trial on his claim under the Americans with Disabilities Act because a jury couldn’t find in his favor, the court said in an unpublished ruling.
