Ruby Tuesday Inc. and a group of restaurant employees have settled for $3 million a Fair Labor Standards Act collective action alleging the company required “off the clock” work and denied overtime pay, according to documents filed in federal district court in New York Sept. 15 (Guttentag v. Ruby Tuesday, Inc., S.D.N.Y., proposed settlement filed 9/15/14).
The proposed settlement would resolve the claims of 4,170 Ruby Tuesday servers, bartenders and bus people who opted into an FLSA lawsuit filed in 2012 in the U.S. District Court for the Southern District of New York.
