Ricoh Worker Fired Under Weapons Policy Sees Age Suit Trimmed

Ricoh USA Inc. convinced a federal judge in Indiana to dismiss a former employee’s claim that firing all workers involved in an incident where a gun was brought to a work site, including him, had a disparate age impact because they were all over 40.

The company was correct that Daniel J. Besiwanger Jr.'s suit doesn’t allege the required statistical disparity needed to prove Ricoh’s facially neutral no-weapons rule had an unintended discriminatory effect, the U.S. District Court for the Northern District of Indiana said.
