A Florida retirement community can’t overturn a jury’s verdict it failed to accommodate a job applicant’s disability during pre-hiring drug testing in connection with her use of prescription medications.
The jury could reasonably infer that the applicant’s PTSD medication would make her fail the drug test, and trial evidence supports the jury’s determination that The Princess Martha LLC, TJM Property Management Inc., and TJM Properties Inc. didn’t engage in an interactive process for disability accommodation, the US District Court for the Middle District of Florida said Monday.
