Reservist Tells High Court Differential Pay Needs Broad Approach

Military reservists called to active duty from federal civilian jobs as a national emergency unfolds deserve differential pay regardless of the nature of their service, a Coast Guard Reserve member told the US Supreme Court.

Federal agencies that employ reservists in civilian roles must make up the difference between their usual pay and the often lesser amount earned while on active duty during a national emergency. “Eligibility turns on one fact: whether a national emergency was ongoing at the time,” according to the merits brief the reservist filed Monday with the high court.
