Republican Commissioner Departing EEOC Means Loss of Swing Vote

Republican EEOC Commissioner Victoria Lipnic has delivered a swing vote in favor of Democratic positions in at least six litigation or policy decisions since November, the latest example of how the slow-going nominations process has influenced agency actions during the Trump era.

Lipnic, whose term on the Equal Employment Opportunity Commission ends July 1, has joined with Democratic Commissioner Charlotte Burrows to outvote GOP Chair Janet Dhillon in those 2-1 decisions, four of which involved age discrimination in the workplace, according to a Bloomberg Law analysis of four months of publicly available EEOC votes.
