A group of recruiters successfully blocked an IT staffing firm from saying they fall outside overtime protections, and the company failed to show any wage violations weren’t willful.
The workers’ evidence demonstrated that the Fair Labor Standards Act’s administrative exemption doesn’t apply to their jobs, the US District Court for the Western District of Pennsylvania said, granting their partial summary judgment bid. But there’s still a factual dispute over whether TEKsystems Inc. willfully violated federal wage law, which would extend the limitations period by a year, the Wednesday opinion said, denying the company its own early win.
