Quest Patient Services Reps Win Class Status for Break Claims

Quest Diagnostics Clinical Laboratories Inc. workers may proceed as a class on claims that the company kept them from taking rest breaks, but not on a race discrimination claim, a federal judge in California said.

Patient services representatives say the clinical laboratory company, a Quest Diagnostics Inc. subsidiary, effectively prevented them from properly utilizing their rest breaks and discriminated against Black workers. The rest break allegations meet the requirements for class certification, but the discrimination portion of the case falls short, the US District Court for the Southern District of California said.
