Quest Diagnostics Ex-Employee Defeats Arbitration Bid, For Now

Quest Diagnostics lost its bid to compel arbitration in an employment discrimination suit because there was contradictory evidence over whether the plaintiff signed the arbitration agreement.

The US District Court for the District of New Jersey on Monday in an unpublished opinion granted both parties leave to conduct limited discovery to determine whether Chris Burk signed the agreement as part of his employment with the company.
