Proposed Class Action Targets Family Visa Delays That Block Work

Backlogs at US Citizenship and Immigration Services have created a “bureaucratic nightmare” for immigrants approved for family-based visas who are unable to work in the US while waiting for those visas to come through, according to a new proposed class action.

The lawsuit filed Monday in the US District Court for the Western District of Washington challenges delays in deciding provisional unlawful presence waivers, which are required before formerly undocumented immigrants can secure lawful permanent residency in the US on the basis of marriage to a US citizen or green card holder.
