Project Labor Agreements Face First Amendment Challenge

The Minneapolis Public School District’s policy of only using construction contractors that hire unionized workers and contribute to union benefit funds allegedly violates constitutional protections for free speech and due process, according to a new federal lawsuit.

The Associated Builders and Contractors’ Minnesota/North Dakota Chapter filed a complaint March 12 that challenges the school district’s union-only project labor agreements. PLAs are pre-hire deals that set the terms and conditions of employment. The construction industry group is represented by the Pacific Legal Foundation, a conservative legal advocacy organization.
