A case challenging an personal care and hygiene product manufacturer for failing to accommodate a pregnant worker will head to a trial, a Tennessee federal judge ordered.
Vi-Jon LLC’s motion for summary judgment was denied Tuesday in the lawsuit alleging it violated the Pregnant Workers Fairness Act by firing Kelse Neal after placing her on unpaid leave and denying her other accommodations. Judge Aleta Trauger of the US District Court for the Middle District of Tennessee said there are genuine material fact disputes regarding Vi-Jon’s alleged failure to provide the accommodations preluding summary judgment.
