Precision Drilling Workers’ FLSA Wage Suit Revived by Third Cir.

Precision Drilling Corp. will have to face Fair Labor Standards Act claims after all by more than 1,000 oil and gas rig workers who allege they didn’t get overtime wages for time spent donning and doffing personal protective equipment, according to a Third Circuit ruling released Monday.

The lower court properly excluded an expert’s opinion about the workers’ exposure to toxic chemicals and the protectiveness of their PPE. But it improperly concluded they couldn’t prove their claims without the testimony, the U.S. Court of Appeals for the Third Circuit said.
