Popeyes Beats Biometric Suit Over Workplace Fingerprint Scans

Popeyes Louisiana Kitchen Inc. defeated for now a proposed class action alleging it collected employees’s fingerprints without proper consent in violation of the Illinois Biometric Information Privacy Act.

Lead plaintiff Brunettea Jones established that she had standing to sue in federal court, the US District Court for the Northern District of Illinois ruled Thursday. But she has so far failed to allege facts indicating that Popeyes was responsible for the collection of her biometric information that took place at a franchise operated by its co-defendant Diamond Jubilee Enterprises Inc., Judge Edmond E. Chang said.
