Plumbing Supplier Fails to Nab High Court Review of Overtime Row

A plumbing and HVAC supply wholesaler fighting allegations of stiffing its sales workers on overtime failed to convince the US Supreme Court to weigh in on the proper analysis for an exemption Monday.

F.W. Webb Co. asked the high court to review a decision blocking it from taking advantage of a Fair Labor Standards Act carveout for administrative employees—which the wholesaler says is “likely the most-litigated of the statute’s exemptions"—as part of the company’s defense to a US Labor Department lawsuit alleging it failed to pay inside sales representatives for their overtime.
