A black man who developed bilateral shoulder problems while hanging live chickens at a Pilgrim’s Pride Corp. plant can’t prove job discrimination, a federal judge ruled.
Johnny Mack Mitchell, whose shoulder issues persisted despite surgery and being moved to various jobs, claimed he was mistreated because he is black and was disabled or perceived to be disabled. But he failed to identify a worker outside of either protected class whose circumstances were similar to his yet was treated better by the company, the U.S. District Court for the Middle District of Florida said July 16.
