A $1.2 million settlement between Phoebe Putney Health System Inc. and employee-participants in its health insurance plan has received preliminary approval by a federal judge in Georgia (Edwards v. Phoebe Putney Health Sys., Inc., M.D. Ga., 1:15-cv-00075-LJA, 4/25/16).
The settlement would bring an end to the participants’ claims that Phoebe Putney breached its fiduciary duties and engaged in prohibited transactions under the Employee Retirement Income Security Act by allegedly selecting a company subsidiary as the network provider for the plan instead of an alternative, less expensive provider.
