Peterbilt Motors Must Face DOL’s Covid-19, OSHA Retaliation Suit

Peterbilt Motors Co., a subsidiary of PACCAR Inc., failed to stop a Labor Department lawsuit alleging it unlawfully retaliated when it fired a worker after he raised concerns about Covid-19 safety protocols at the company’s Texas factory.

The department has the authority to bring the suit despite the US Supreme Court’s Nat’l Fed’n of Indep. Bus. v. Dep’t of Lab., OSHA decision holding that OSHA was unauthorized to enact a mandatory vaccination or testing mandate, the US District Court for the Eastern District of Texas said.
