Petco, Manager With Fibromyalgia Headed for Bias Trial (Correct)

A jury must decide whether Petco Animal Supplies Stores Inc. interfered with an employee’s right to protected leave for a severe flareup of his fibromyalgia when it refused to return him to his store manager job with certain work restrictions recommended by his doctor, a federal judge in New Mexico ruled.

A trial is also needed to determine whether Petco denied Matthew Donlin reasonable accommodation under the Americans with Disabilities Act and state law, the U.S. District Court for the District of New Mexico said.
