Workers who allege a pest control company made them do some job duties off the clock and stiffed them on overtime defeated a bid to strip class claims from their wage-and-hour suit.
Two workers who joined the suit against Greenix Holdings LLC to represent proposed classes under Illinois and Pennsylvania law can continue pursuing their portions of the case, the US District Court for the District of Utah said. The company didn’t meet its burden to show that it’s clear from the complaint that the workers can’t meet class action requirements, the Thursday opinion said.
