Perdue misclassifies chicken farmers as independent contractors instead of employees despite dictating “nearly every aspect of how they run their farms,” a worker alleges in federal court in Georgia.
Perdue Farms Inc. and Perdue Foods LLC use “promises of independence” to induce farmers, referred to as “growers,” to raise chickens, according to the would-be class complaint filed July 22 in the US District Court for the Middle District of Georgia. But the poultry producer exercises so much control over growing operations that the workers should be classified as employees entitled to additional wages and benefits, the complaint says.
