Perdue Defeats Chicken Farmer’s Worker Status, Overtime Claims

Perdue Foods LLC is free of all wage-related claims in a chicken farmer’s lawsuit alleging the company misclassified him as an independent contractor and deprived him of pay.

Even if the worker can provide enough detail to suggest he counts as an employee under the Fair Labor Standards Act, he didn’t file his complaint within the law’s standard two-year statute of limitations, so his claims are time-barred, the US District Court for the Middle District of Georgia said.
