Penske Gets Some Worker Bias Claims Axed, Others Head for Trial

Penske Logistics LLC defeated part of a former employee’s disability discrimination and retaliation lawsuit, but a trial is necessary to resolve the worker’s remaining claims stemming from his post-car crash firing, a federal judge said.

The worker didn’t show that the company retaliated against him for seeking time off under the Family and Medical Leave Act after his accident, and he “produced no evidence suggesting that he was or is disabled,” the US District Court for the Northern District of Texas said.
