The Peace Corps convinced a federal judge to narrow the claims a lawsuit alleging the foreign public service agency rejected a group of would-be volunteers based on their disabilities.
The volunteers allege that the program’s mental health screening guidelines run afoul of a federal disability law and prohibitions against arbitrary and capricious agency action. But the Rehabilitation Act doesn’t give them an avenue to sue and the guidelines aren’t a final agency action under the Administrative Procedure Act, the US District Court for the District of Columbia said Tuesday.
