Outback Steakhouse Won’t Face Overtime Collective Action (1)

Bloomin’ Brands Inc. and OS Restaurant Services LLC, operating together as Outback Steakhouse, convinced a federal court in Massachusetts to deny conditional collective action certification of a wage-and-hour case brought on behalf of “front of house” managers.

Carlos Chavira sought to represent a class of Outback workers employed as front of house managers in restaurants across the U.S. He alleged that front of house managers were misclassified as exempt from the overtime requirements of the Fair Labor Standards Act.
