An administrative law judge needs “to make credibility determinations” concerning evidence about whether the U.S. Postal Service retaliated against two mail carriers for reporting work-related injuries, the Occupational Safety and Health Review Commission said in a ruling made public Wednesday.
One of the carriers claimed he faced discipline after reporting a work-related shoulder injury related to lifting a mail sack. The carrier’s supervisor said he disciplined the employee after the employee demonstrated an improper lifting technique, while the employee said he didn’t make such a demonstration in reporting his injury.
