OSHA Counters Steel Company’s Attack on Safety Panel Legality

A steel fabrication company isn’t entitled to block its scheduled administrative proceedings before the independent agency that hears appeals to OSHA citations, the government argued in New Jersey federal court.

Kenric Steel LLC sued the US Occupational Safety and Health Review Commission to block enforcement of a $348,000 safety fine against it in the US District Court for the District of New Jersey. Notably, the company isn’t fighting the specific allegations from OSHA’s investigation, instead choosing to challenge the removal process and term limits for members of the OSHRC as unconstitutional.
