Ohio Police Officer’s Age Harassment Suit Revived for Jury Trial

Blue Ash, Ohio, must face a trial on whether it harassed a long-time police officer based on age, the Sixth Circuit held, further clarifying its standard for assessing hostile environment claims.

The ruling Monday partly revived the officer’s Age Discrimination in Employment Act lawsuit, with a unanimous panel saying discrete job actions can be evidence of harassment, even if they also give rise to a separate cause of action for discrimination.
