A former radiologist’s allegations that New York City Health and Hospitals Corp. discriminated against her because she’s in her 70s belong in front of a jury, but her similar claims against an affiliated state university fall short.
The radiologist put forth evidence that NYCHHC’s purported performance-based termination was actually a pretext for age discrimination, the US District Court for the Eastern District of New York said. However, she didn’t make out a prima facie bias case against SUNY Downstate, where she worked as an assistant professor, the opinion said.
